2. Scope
These terms govern your access to and use of PhpThunder, related account and activation services, support services, documentation, and any associated website functionality that we make available to you.
By placing an order, creating an account, activating a license, or using the software or related services, you agree to these terms.
3. Accounts and organizational use
You are responsible for keeping your account credentials confidential and for ensuring that access to your organization, workspace, and licensed seats is limited to authorized users. You must provide accurate account and billing information and keep it up to date.
4. License grant
Subject to these terms and payment of the applicable fees, we grant you a limited, non-exclusive, non-transferable, revocable right to use the software for your internal business or professional development purposes.
Use is limited to the number of seats, users, workspaces, and device activations included in the plan you purchased or that we otherwise made available to you in writing.
5. Permitted use
You may install and use the software in accordance with the purchased plan, our documentation, and any technical limits shown during purchase or account management. You may allow your authorized team members to use seats assigned to them within your organization.
6. Restrictions
You may not, except where mandatory law requires otherwise:
- copy, distribute, sublicense, sell, rent, lease, or commercially resell the software;
- share license access beyond the purchased seats or outside your organization;
- reverse engineer, decompile, disassemble, or attempt to extract source code from proprietary parts of the software;
- remove proprietary notices or circumvent licensing, activation, seat, or technical protection mechanisms;
- use the service for unlawful activity, security abuse, or activity that interferes with the service for others.
7. Orders, subscriptions, and payments
Fees, billing intervals, seat counts, and plan details are shown during checkout or in your account area. Unless stated otherwise, fees are payable in advance and taxes may apply in addition to the listed prices.
If you buy a subscription, it continues for the selected billing period until it is canceled in accordance with the applicable plan and billing flow. Changes to seats or subscription status may take effect immediately or at the next billing milestone, depending on the billing model in use.
8. Updates, support, and availability
We may release updates, fixes, and improvements to the software and related services. Support is provided as described on the website, in the purchased plan, or in separate written agreements. We do not guarantee uninterrupted availability of the website or services.
9. Intellectual property
The software, website content, branding, documentation, and related materials remain our property or the property of our licensors. These terms grant only a right to use the service as expressly stated and do not transfer ownership or any broader intellectual property rights to you.
10. Suspension and termination
We may suspend or terminate access if you materially breach these terms, use the service unlawfully, fail to pay applicable fees, or create a security or abuse risk for the service or other users. You may stop using the software at any time and may cancel subscriptions through the applicable billing flow, subject to the terms of your current billing period.
11. Warranty disclaimer
To the extent permitted by law, the software, website, and related services are provided on an "as is" and "as available" basis. We do not guarantee that the service will be error-free, uninterrupted, or suitable for every workflow or legal requirement.
12. Limitation of liability
To the extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, downtime, or business interruption. Our aggregate liability arising out of or related to the service is limited to the fees paid for the relevant service during the twelve months preceding the event giving rise to the claim.
Nothing in these terms limits liability that cannot be excluded by law, including liability for intent, fraud, gross negligence where mandatory law so requires, or liability for death or personal injury caused by negligence.
13. Governing law
These terms are governed by the laws of Cyprus, excluding its conflict-of-law rules, unless mandatory consumer protection law requires otherwise.
